These Terms and Conditions govern the contractual agreement between you (the "Customer" or "Shipper") and Artha Abadi Indonesia Ltd ("AAI Express", referred to as "we," "us," or "our"), outlining the terms under which we provide our comprehensive freight forwarding services.

By engaging our services, you acknowledge that you have read, understood, and agreed to abide by these Terms and Conditions. This document must be carefully reviewed to ensure a smooth and efficient shipping process. 

At AAI Express, we are committed to delivering excellence and providing reliable logistics solutions tailored to your unique requirements. Our mission is to streamline the transportation of your goods, offering a seamless experience that fosters trust and long-lasting partnerships.

These Terms and Conditions encompass a range of essential aspects, including our responsibilities as a freight forwarding company, your responsibilities as the Customer, liability limitations, insurance provisions, payment terms, and more. We aim to maintain transparency and clarity throughout our partnership, ensuring your cargo reaches its destination safely and on time.

We reserve the right at our sole discretion to amend, amend, or add to the T&Cs at any time in an unlimited number of times and without limitation by posting the revised version of these T&Cs at AAI Express (“Latest T&Cs”). These Terms and Conditions govern the contractual agreement between you (referred to herein as the "Customer" or "Shipper") and Artha Abadi Indonesia Ltd, hereinafter referred to as "AAI Express." This agreement outlines the terms and conditions under which AAI Express provides its comprehensive freight forwarding services. By utilizing our services, you acknowledge and agree to be bound by the terms set forth herein. Please read these terms carefully and contact us with questions or concerns before engaging our services.

These T&Cs shall constitute one single document with the Agreement and shall not be interpreted separately.

Definition

  1. Artha Abadi International Ltd (AAI Express) is a service provider or intermediary company for shipping or delivering documents and/or goods.

  2. Agents are AAI Express staff or us who are authorized or appointed to represent or act on behalf of the agency and have a permanent relationship with those they represent.

  3. The Carrier is the third party carrying the Package.

  4. The Sender, or can be referred to as the Customer, is the individual or you who receives the services provided by AAI Express.

  5. The Beneficiary is an individual or business entity/company whose identity is listed/written in the invoice as Package Recipient.

  6. Valuable Shipments are types of shipments that are mandatory for insurance companies that cooperate with AAI Express.

  7. The Drop point address is the Address for the collection of Packages that the Shipper sends to AAI Express under an Order.

  8. Packages are items that are the subject of an Order.

  9. Orders (which can include more than one (1) piece of goods, Pick-up Address, and/or Delivery Address) that the Shipper makes and receives by Our Agent will include these terms and conditions.

  10. The Marking Code is the Address code the Sender enters when sending the Package to the drop point in the country of origin.

  11. Packaging is the activity of entering, sealing, labelling, enveloping, wrapping, binding, packing, or similar activities under AAI Express instructions from time to time.

  12. Shipping Address is the Address for the Delivery of Packages that the Sender provides to Our Agent following the Order (including a drop-off or hub address), being an Address that is easily accessible to Our Agent and capable of receiving Delivery at any time (and does not include, for the avoidance of doubt, PO Box or equivalent unmanned Address).

  13. Prohibited Goods are any goods that Our Agent does not accept from time to time, including, without limitation, dangerous, dangerous, explosive, or illegal goods, including, without limitation, those specified in the List of Prohibited Items or identified as listed on the website.

  14. Serving the collection, transportation, and Delivery of Packages following the Order.

  15. Force Majeure is any event, condition/condition, or event beyond the ability, power, or control of AAI Express, and such event, disease/illness, or event hinders, hinders, or delays AAI Express in carrying out its obligations to carry out delivery services. Force majeure events include but are not limited to natural disasters, floods, landslides, volcanic eruptions, hurricanes, storms, earthquakes, lightning, rebellions, riots, riots, war or military action, fires, embargoes, strikes, sabotage, unavailability of electricity, disruption of telecommunications networks and/or the issuance of decisions, policies, regulations, or the implementation of an action by the authorities that hinders, hinders or directly delays the performance of a party's obligations under this Agreement. 

 

Our Service Agreement with You

  1. How We will accept Your Order is subject to paragraph 2 below; acceptance of Your Order will occur when We receive payment in full from You (or if You have a credit with Us), at which time an agreement will be entered between You and Us.

  2. If we are unable to receive your Order, we will inform you of this. This can happen because your package is included in the category of prohibited goods or because our agents are unable to arrange pick-up and/or delivery to specific addresses, regions, and areas where we cannot meet the delivery time limit you have specified or for other reasons.

  3. If we have received payment from you, we will refund the payment minus the costs we have incurred unless we do not accept your Order because part or all of it relates to the prohibited goods, in which case no refund will be made.

  4. Your Order Number. We will assign an Order number to each of your Orders and inform you via customer service chat and web app. You will be asked to notify Us of your Order Number and any tracking references whenever You contact Us about Your Order. 

 

Scope of Services

  1. We will provide Services according to the Order with due skill and care.

  2. In order to improve the quality of service to Senders, we may make such changes to the Service as reasonably necessary from time to time.

 

General Information About Delivery Service

  1. All transactions in connection with the Delivery Service are carried out based on the terms and conditions set out in the applicable Terms and Conditions.

  2. Shipping Services include:

  • Shipping from the United Kingdom (UK)

  • Shipping from the United States (USA)

  • Shipping from the European Union (EU)

  • AAI Express's project cargo

  • Tailored Delivery Service on Customer's request

  1. Pick-up service – Please note that if you order your package pick-up service through a collection point with a maximum distance of five kilometers (5 km) from our drop-point location, we will charge an additional administration fee for the pick-up service.

  2. Suppose the Order data provided needs to be corrected and impacts returning/delivering the Package to the store or seller or for other reasons related to non-compliance with our Terms and Conditions of service and causing the cancellation of this agreement. In that case, We cannot refund administrative fees.

  3. The sender must provide complete and correct information to AAI Express about the shipment's contents stated at the time of delivery.

  4. According to the order data in the shipping invoice, the sender guarantees that the person concerned is the rightful owner.

  5. If, in the process of sending your Package from the store or seller, there is a discrepancy with your data, such as a shortage of goods, functional damage, and/or loss of goods when arriving at our drop point address, your complaint to the store or seller is your responsibility.

  6. Estimated delivery to your address is a maximum of thirty-five (35) working days, excluding national holidays in the country of origin and/or destination country since the Package was sent from the drop point of the country of origin.

  7. Our agent will inform you when The Sender can pick up the Package and is willing to provide storage facilities for ten (10) calendar days since the Package arrives for free. If the storage period has passed, you will be charged a storage administration fee.

  8. The standard storage period for items within our facility is ten (10) calendar days from the date of receipt. In the event of non-compliance with extended storage terms, AAI Express reserves the right to dispose of the stored items without further notice. Disposal may include recycling, donation, or any other method deemed appropriate by AAI Express. AAI Express shall not be held liable for the disposal of items stored beyond the specified period. It is the customer's responsibility to adhere to the agreed-upon storage terms and claim their items within the stipulated timeframe.

 

Shipping Service Terms

  1. Through these terms and conditions, our agents can check packages at the drop point of the country of origin.

  2. If there is a discrepancy in the Package received through our agent or the Package does not follow these Shipping Terms and Conditions, such as the Forbidden Items listed in the List of Prohibited Items, we will reasonably inform you, and our agent will store it for ten (10) calendar days) the drop point of the country of origin and does not process the delivery of the Package. If the storage duration has exceeded and the Sender has not decided on the following action, the Package will be destroyed for security reasons.

  3. In the event of detention, confiscation, or destruction of the PACKAGE by the competent authority, which includes but is not limited to Customs, Quarantine, Police, Prosecutors, and other authorized agencies, which causes damage, loss or reduction of the PACKAGE, it is not the responsibility of AAI Express and AAI Express cannot be sued and released from the responsibility of returning the PACKAGE and shipping costs in part or in whole.

  4. Our agent will measure the dimensions or volumetric of your Package. If the dimensions of the Package are greater than the weight of the Package, we will calculate based on the cost of the measurements (package weight) and inform you.

  5. Dimensional or volumetric calculations are Length (Cm) X Width (Cm) X Height (Cm) divided by 5000 = Package Weight (Kg).

  6. Our agents will try their best to inform you of the contents of your Package received at the drop point in the country of origin via customer service chat and web app.

  7. Our agents will try, according to our skills, to check the contents of your Package in the event of physical damage or product defects due to the delivery process by the Carrier. These conditions will be entirely your responsibility.

  8. In the delivery process, it is your responsibility to check your Package's eligibility conditions before making the delivery process. If your Package requires special handling, such as additional boxes and/or additional wooden packing, you are advised to inform our agents and be willing to pay for additional costs that arise for these needs.

  9. We are not responsible for any delays or changes to the service due to an event occurring beyond Our control or the control of the Carrier or Our Agents. We will make reasonable efforts to contact you immediately and inform you of delays or changes.

  10. The Sender is expected to comply with orders that are placed and processed directly through online stores. Suppose a discrepancy in the writing of the Marking Code or drop point address is found and causes delivery errors by the Carrier. In that case, this becomes the full responsibility of the Customer.

 

Conditions When Loading and Unloading Packages

  1. Our agents in the country of origin only load the package properly using general package packaging equipment such as double wall card boxes with a maximum size of twenty-five (25) kilograms per box, bubble wrap and cross weave tape.

  2. Our agents do not have special equipment to carry out the process of loading and/or unloading Packages.

  3. Unless otherwise agreed in writing, We will not be required to provide any special equipment or additional personnel other than the individual collection or delivery of Goods for collection or delivery.

  4. If special equipment is required for loading and unloading packages, it is your responsibility for such special equipment according to mutual agreement. To the extent such additional equipment or personnel is needed, You are obliged to indemnify Us for any damage caused during loading or unloading of Goods, whether caused by Our negligence or additional personnel or third-party claims in connection in addition to that.

 

Shipping Service Fee Information

  1. The cost of shipping services from the country of origin to the drop point address can be seen on this link or informed by the AAI Express Agent.

  2. Service fees are general and are subject to change according to the conditions set by the Carrier.

  3. Each Package of premium products such as bags, wallets, footwear, watches and other clothing accessories will be subject to an additional premium surcharge in addition to the shipping service fee, which the Sender will notify further.

  4. If a discrepancy in the value of the invoice is found by the Carrier and/or local customs officers or related agencies, we will charge the difference in costs to the Sender in accordance with the bill submitted to our agent. And the Sender must pay the bill.

  5. Shipping costs from the country of origin to the drop point address are not binding. If the weight/volume of the goods is more significant than what was calculated when our agent informs us of the offer, then we will bill the difference in costs to the Sender. This may happen if the Carrier charges us the difference in prices. And it is the obligation of the Sender to pay the bill.

  6. What happens if the weight or size is wrong, Our fees are based on the details of your Package weight and size and Shipping Address and other pick-up and delivery details that you enter into the order process. If you have made an error in this information that has resulted in an additional fee, you are responsible for the additional fee.

  7. The cost of shipping services from the country of origin to your address does not include the cost of shipping domestic expeditions to the shipping address.

  8. We will not be responsible for customs fees, import taxes, duties or other similar charges incurred by the Carrier and/or freight forwarder. You must confirm if any of these fees are due prior to completing Your Order with Us. If any fees are due as a result of carriage and/or delivery of goods on your behalf and charged to us by the competent authority, you agree to reimburse us in full within three (3) days of the request by our agent. We are not obligated to pay such fees unless You have paid Us an amount equal to the cost at the time You placed the Order, and You will be responsible for all costs incurred in connection with the storage, disposal and/or return from the store or seller at where these fees are collected and any fines or penalties incurred. It is your obligation to know the documents needed to complete the customs process because Artha Abadi International Ltd. does not manage customs clearance in the local country. Keep in mind that each country has its regulations regarding export and import activities, so if you are going to make international shipments, it is better to learn more and comply with the rules for sending Packages to avoid problems at customs.

 

Shipping Service Payment Method

  1. Payment is made in whole or in full after the Package arrives at the drop point of the destination country via the bank transfer listed in our invoice.

  2. Complaints about package weight discrepancies can only be served when the Package is still at the drop point in the country of origin; complaints about inconsistency in shipping service fees after your Package has been entered at the drop point in the destination country cannot be tolerated.

  3. It is your responsibility to find information on your Package's weight and/or volume via customer service chat and web app.

 

Shipping Security Guarantee

  1. AAI Express and the Carrier make every effort to maintain, care for, and deliver your Package until it is well received at the Shipping Address.

  2. The sender is responsible for protecting the Package with adequate insurance and bears the value of the applicable insurance premium costs.

  3. For a product value of more than IDR 1,500,000 (one million five hundred thousand Rupiah), it is highly recommended to use shipping insurance.

  4. Your protection if you have an insurance facility that you buy through us in the form of a replacement of 80% of the package value that you declared when the Package was received by our agent in your country of origin or a maximum of Rp15,000,000 (fifteen million Rupiah) reimbursement.

  5. Packages that cannot use additional insurance facilities are packages with a value above Rp. 15,000,000 (fifteen million Rupiah) in every shipping transaction and/or Package included in the List of Prohibited Goods.

  6. If you choose not to use insurance with us and there is loss or damage to goods that occur due to negligence of AAI Express, we can provide a replacement fee of up to a maximum of ten (10) times the shipping cost or the value of the Package does not exceed Rp. 1,000,000 (one million Rupiah). The total delivery value of Your Package is taken at the lowest value or at AAI Express's decision on each shipment that you send with us and does not apply to the accumulation of multiples of the replacement cost.

  7. It is your responsibility to seek information regarding the security of your package delivery, such as adding insurance facilities and/or adding special packaging, such as card boxes and/or wooden crates, to our agents.

 

Cancellation of Delivery Service Order

  1. Requests for cancellation of shipping services that are in the process of being shipped and/or shipments that Our Agent or Carrier has processed cannot be approved for any reason.

  2. Fees paid for cancellation requests are non-refundable for any reason.

 

Operating Hours

  1. The operational hours for picking up your Package that has arrived at the destination country are as follows:

  2. Monday to Friday from 09.00 to 17.00 WIB.

  3. Saturday by appointment via customer service chat.

  4. Closed on Sundays or national holidays.

  5. If you do not comply with operating hours and cause misunderstandings with you and/or your messenger courier, then we are not responsible for any losses that arise.

 

Terms About Personal Shopper Service

  1. All transactions related to Personal Shopper Services (purchase deposit services) are carried out based on the applicable terms and conditions.

  2. The Personal Shopper service does not serve tax refund requests, and our agents cannot accept any power to represent and carry out this application.

  3. Personal Shopper services include:

  • Ordering services for goods or products online.

  • The service of ordering goods or products directly at the store or seller directed by the Customer to the AAI Express Agent.

  • We will apply an additional administrative fee for every transaction.

 

Personal Shopper Service Information

  1. Customers can send product site links to be ordered by our agents via customer service chat. Our agents will send an offer for the purchase price of goods and help place orders after our agents receive confirmation and proof of payment in whole or in full.

  2. Starting January 2021, there will be an additional customs duty tax for purchasing products from countries that are members of the European Union sent to the UK.

 

Personal Shopper Service Payment Method

  1. Payment is made in whole or total according to the price quote confirmed via bank transfer.

  2. The payment method is only a medium given to customers. If there are complaints related to orders, customers are only allowed to submit complaints via customer service chat to our agents and do not leave any comments on our marketplace.

  3. Additional administrative fees for bidding requests, raffles, offers, or similar special services that our agents do not successfully process are non-refundable for any reason.

  4. The Customer has the right to receive a full refund if the item to be ordered is unavailable.

  5. Our agent will make a refund, which the seller processes.  Our agent will inform you if the order is unsuccessful and/or with conditions requiring special handling.

  6. The refund value will follow the exchange rate processed by the Bank when the funds are received in full by Our Agent from the seller.

 

Personal Shopper Service Order Cancellation

  1. Order cancellation requests after purchases are completed and processed by Our Agent cannot be approved for any reason.

 

Damage to Packages Due to Shipping by Carrier

  1. If there is damage to the package due to the shipping process from the store to our agent's drop point in the UK/EU/US area or there is a product defect, then you can apply for a product replacement to the store on the grounds of product defect or malfunction. This return process takes approximately 21 calendar days or more.

  2. Our agents can help you make this delivery. If there are costs arising due to this return process, we will invoice the costs incurred to you.

 

Our Responsibility for Loss or Damage that You Suffer

  1. AAI Express is liable to You for any foreseeable loss and damage caused by Our negligence. Suppose We fail to comply with these requirements. In that case, We are responsible for any loss or damage You suffer due to Our breach of this contract or failure to use reasonable packaging equipment and craftsmanship. Still, We are not responsible for any loss or damage that is not predictable. Loss or damage that may be foreseen if it will occur or if, at the time, another agreement is made between Us and You will know it may appear. Liability: We will remain subject to other agreements and these Terms and Conditions.

  2. We do not exclude or limit in any way Our liability to you in any unlawful manner. This includes liability for death or personal injury caused by Our negligence or the negligence of Our employees or Agents and for fraudulent practices or misrepresentations.

  3. We are not liable for any direct or indirect damages (including, without limitation, loss of profits, loss of goodwill, loss of business or business opportunity, business interruption, or special, indirect, or consequential damages).

  4. We are not responsible for your behavior towards our services. We are not liable for any damages caused as a result of your breach of these terms or your Order, including, without limitation, by defective packaging, misleading or incorrect labeling, inaccurate measurement or weighing of the Goods, or in connection with the Goods being a Prohibited Goods. We reserve the right to suspend or terminate the provision of services if you violate these terms and are responsible for repaying us for any additional costs incurred or losses suffered.

  5. Our liability is limited. If We are liable to You, We will only be liable up to the maximum amount You paid for Your Order. Any losses will be calculated on the same basis. You have insurance coverage through your own insurance that you purchased as part of the Order. If you don't purchase additional insurance, you do so at your own risk. Artha Abadi International Ltd does not provide insurance against Orders and/or Delivery Services.

  6. Events beyond our control. We are not responsible for any loss or damage caused by any event beyond Our control, including, without limitation, weather conditions, transportation delays or bottlenecks, strikes, lockouts, sanctions, severance of diplomatic relations, governmental or public actions—authority or restriction on imports or exports or acts of God.

  7. AAI Express shall exercise due diligence in handling shipments and will take reasonable care to prevent loss or damage to your Goods during the course of transportation. We will not be liable for any loss or damage to your Goods.

  8. By submitting the Package to AAI Express, the Sender is deemed to have read and agreed to the Shipping Terms and Conditions that apply to AAI Express without any coercion from any party and releases AAI from all claims and forms of compensation.

 

How We Use Your Personal Information

  1. To provide the Services to you and to get your feedback regarding the services we have provided, directly or through third parties.

  2. To process your payment for our Services.

  3. To verify the information in an Order, including, without limitation, your identity and Address and pick-up and delivery address.

  4. To avoid fraud or other unlawful activities; and

  5. If you agree to this during the order process, we will provide you with development information about similar services that we or our partners, agents, and subcontractors provide, but you can request to stop receiving these updates at any time by contacting us.

  6. In accordance with point 1 in this section. We will only provide your personal information to third parties if the law requires or allows us to do so.

  7. In accordance with point 1 in this section. You will find more information about Our Privacy Policy, which is incorporated into this agreement, details of which can be found through international air freight information.

  8. Conditions that apply to air transportation. The IATA terms will apply to any Order that is subject to transport by air, but only to the extent that the Order or part thereof is subject to transportation by air and will not apply to any part of the Order that is not subject to it. Liability: We will be subject to the maximum amount in IATA. You are deemed to have agreed to the provisions of the articles limited by IATA (International Air Transport Association), ICAO (International Civil Aviation Organization), and ADR (European Road Transport)—regulation of dangerous goods or other related organizations by agreeing to these terms.

 

List of Prohibited Items

  1. Merchandise, substances, and documents that do not comply with the laws of any country of origin, destination, or transit country. Merchandise whose export is prohibited from the country of origin or import to the country of destination.

  2. Dangerous Objects: Please note that even if the delivery uses an economy service, the goods may be shipped by air, and you should pay special attention to the regulations regarding dangerous goods. Similarly, any item packaged with an ADR label, regardless of the actual content, will be considered a Prohibited Goods. All Dangerous Goods, even in limited quantities, include Acids, Adhesives, Aerosols (ADR class), Agricultural chemicals, Ammunition, Bacteria, Camping Gas, Coal, Corrosive Materials, Dry Ice, Diving Tanks (Sub aqua), Fire Extinguishers, Firecrackers, Fireworks, Flammable liquids, Flammable perfumes, Flammable substances, Flares, Gasoline lighters, Gunpowder, Hydrochloric acid, Compressed gases, Liquor lighters, Lighters, Magnetic products, Mercury compounds, Mercury, Motors, Oil-based paints, Oxidizing agents, Oxygen-generating chemicals, Peroxides including bleaching powder, Pesticides, Phosphorus, Radioactive materials, Toxic and infectious substances, Viruses, Wet batteries and other items not listed which are not ADR compliant.

  3. Other Prohibited Items:

  • Weapons, Ammunition, Military Equipment, and other similar items.

  • Animals, pets, or wild – alive or dead.

  • Biological samples.

  • Cash, credit cards, postage, checks, and lottery tickets.

  • Human remains, cremated or buried, and their derivatives, marijuana, cocaine, and other narcotic and psychotropic drugs. Original work of art.

  • Perishable Goods or Foodstuffs.

  • Precious Jewelry.

  • Precious Metals and Stones.

  • Prescription drugs.

  • The law prohibits delivery (liquids, alcohol, food, plants).

  • Unaccompanied baggage.

  • Food products that may be prohibited by the Plant Protection Act.

  • Fresh food (Vegetables, fruits, etc.).

  • Items that require temperature regulation/perishable items.

 

Coverage

  1. You can help ensure that your Package arrives safely and that your insurance rights are not canceled by:

  2. Use a strong and rigid box to send the Package's contents.

  3. Wrap all items to be placed in Packages separately.

  4. Use adequate cushioning material between items in the Package.

  5. Use strong tape designed for shipping packaging.

  6. Removes old, invalid box labels.

  7. Ensure Address labels with clear and complete shipping and return information.

  8. Place a duplicate Address label inside the packaging.

  9. We recommend that you take photos of the Package before and after closing the Package.

 

Other Important Terms

  1. We may transfer this agreement to another person. We may transfer our rights and obligations under these terms to other organizations.

  2. Neither party has any rights under this agreement. This agreement is binding between you and us. No other party has the right to enforce any of its provisions unless expressly stated otherwise in these terms.

  3. The rest will continue if the court finds part of this deal illegal. Each paragraph of these terms operates separately. If a court or relevant authority decides that any of them is unlawful, the remaining paragraphs will remain in full force and effect.

  4. Although we delay the implementation of this agreement, we can still enforce it at a later time. If We don't immediately urge you to do whatever you have to do under these terms, or if We delay taking action against you concerning your breaking this agreement, it doesn't mean that you don't have to do those things. It won't prevent us from taking steps against you at a later date. For example, if you miss a payment and we don't charge you, but we continue to provide products and services, we may still ask you to make a payment at a later date.

 

Complaints and Constraints

  2. Your legal rights. Nothing in these terms will affect your legal rights to the extent that these terms cannot change them.
